How to update when update is not working?

I have the weird situation that the T5 does not update.
At the moment there is firmware version 9.3.15 installed.
Online update says: system is up to date.
When I download the FW 9.3.16 manually and try to update like described here

I get after the reboot the lying andoid figure an his back and the simple message: "Error"
The same happens if I try to update with the same version 9.3.15.
Do you think I should return the device to the seller?
 
Now I am really pissed!
The original device was returned and a new one arrived.
The "new" one is obviously also a returned device because it was not even set back to default, but has the data from the first owner still installed (one from the netherlands). And the device has THE SAME DEFECT as the first one. It was probably returned by the first owner because of the same reasons and sent directly to us without even checking or cleaning!
It was bought from "Conrad" in germany, so I cannot advise anyone to buy devices from them!
And Minix should think about their sellers which give a shoot about the customers, this gives you a bad reputation.
BTW: Minix, this was the second defective device, this does not make your work trustworthy. I am already thinking about buying from another manufacturer.
 
Do you have a VPN, if so try turning that off before auto updating.
That would be a reasonable idea, but I did not use a VPN. Manual update failed too. Do not think about it any more, it was a hardware defect. But thanks for the idea. ;)
 
Please download the firmware files here:

And transfer the .zip file to a USB stick, attach this USB to the NEO T5.

If you device is able to boot up:
Then go 'Settings' > 'Apps', find the "UPDATE" app and open.
Choose "Select" to find the .zip file in the USB, and click "Update" button to update the firmware.

If your device is NOT able to boot up:
Then utilize a needle to hold the RECOVERY button, then attach the power adapter for the device.
It should go to the RECOVERY mode.
In the RECOVERY mode, please choose "Apply update from EXT", and find the .zip file on your USB stick to update the firmware.
 
I just Found this thread, I was wondering if it should have updated, mine won't do the OA update does that mean it's got a fault?
I downloaded the file for the update could that fix the issue if I do it manually?
